Trusts, Estates and Relationship Property

Asset and estate planning can often be complex and emotional. At Lockhart Muir we listen to our clients to establish a comprehensive plan that is tailor-made to meet their needs and objectives.

As families and circumstances change, so arises the need to regularly review and update your trust or estate plan.  We assist our clients to fully review their structures and documentation to ensure the best possible outcome is achieved.

The establishment of clients' family and or trading trusts for the purposes of estate planning and asset protection comprises a significant part of our practice. We take time to discuss the benefits of forming a trust may have with our clients and to fully explain the process and the on-going administration. We are also often asked to review existing trusts and their administration to ensure full compliance with trust law.  Finally, we are regularly engaged on winding-up trusts in situations where the benefits afforded by a trust are no longer applicable.

We advise clients on:

  • Formation, resettlement and winding up of family trusts and business (trading) trusts.
  • Trustees' obligations and beneficiaries' rights and entitlements to distributions and resettlements.
  • Reviewing existing trusts and their administration.
  • Memorandum of wishes.
  • Gifting programs.
